I (hereinafter referred to as "I" with all its grammatical variations and the term shall include their successors, transferees, novatees and permitted assigns) represent, declare and state that:

1. I am a citizen of India;
2. I have not submitted any application for insolvency, been declared insolvent nor has any insolvency and bankruptcy proceeding been initiated against me;
3. my name does not appear on the Reserve Bank of India's ("RBI”) list of defaulters and Export & Credit Guarantee Corporation's ("ECGC") caution list or any list/notifications issued by the RBI wit/ respect to anti money laundering or combating financing of terrorism or any sanctions lists published by the United National Security Council with respect to terrorist related activities;
4. I have no objection to IIFL Finance Limited (“IIFL”) and/ or its group companies and/ or its agents providing information on various products, offers and services provided by IIFL and/ or its group and/or affiliate companies through any mode (including telephone calls/ SMS/ WhatsApp/ emails/ letters etc.) and authorize IIFL and/ or its group companies and/ or its affiliates and/ its agents for the above purpose. I confirm that laws in relation to the unsolicited communication referred in "National Do Not Call Registry" as laid down by "TELECOM REGULATORY AUTHORITY OF INDIA" will not be applicable for such information/ communication to me;
5. I have no objection to IIFL or any of its subsidiaries exchanging and sharing information with its affiliates, group companies, regulatory bodies, government and credit agencies and other such authority as may be required. I give explicit consent to IIFL and authorize IIFL to exchange and/ or share my information, documents and details (as applicable) which may be required for offerings or products / services of its affiliates/ group companies/ subsidiaries;
6. I represent that the information and details provided by me and the documents submitted are true, correct and that I have not concealed any information. In case any of any information submitted by me is found to be false or untrue or misleading or misrepresenting, I am aware that I will be held liable for it in accordance with the applicable laws;
7. I hereby confirm that IIFL has not extended any trade inducements and/ or advisory services;
8. I state that IIFL has not made any commitments or promises with respect to any products offered by its subsidiaries/ group companies/ affiliates;
9. I understand that any products/ services offered by subsidiaries/ group companies/ affiliates of IIFL are subject to terms and conditions as may be applicable for such products/ services and that IIFL shall not be responsible/liable in any manner whatsoever for such products/ services;
10. Provisions for Declaration of Intent to Use Electronic Signature / Digital Signature/ One Time Password (otp)–
    1. I consented to this declaration by means of electronic signature/ otp consent, as per the requirements of the provisions of the Information Technology Act, 2000, executed or adopted with the intent to sign/ consent to this declaration;
    2. I understand that I am not only agreeing to the foregoing document(s) but certifying that I have put my e-signature/digital signature/ otp consent on this declaration/document/instrument for declaring out of my free will and, and have executed this declaration with free and voluntary act for the purposes herein expressed, and that each of the individuals, in the presence of the witnesses or was at the time eighteen or more years of age, of sound mind and under no constraint or undue influence. Any wilful falsification of any information contained herein is grounds for initiation of legal action against me in accordance of law;
    3. I, understand and affirm that this declaration is admissible under Section 65-B of Evidence Act or any other corresponding provision or law for the time being in force;
    4. I, affirm that my consent has been provided on this declaration as mentioned herein, by me and during that relevant period the computer/device/system used for providing my consent was in my lawful control;
    5. I solemnly declare that the use of the electronic signature/digital signature/ otp consent was not done for any illegal or fraudulent purposes.
11. I hereby undertake to indemnify and keep indemnified IIFL and each of their respective directors, officers and employees (the “Indemnified Parties”), and to hold Indemnified Parties harmless from and against any and all claims, damages, losses, liabilities, penalties and expenses (including all fees and charges of internal or external counsel with whom Indemnified Parties may consult and all expenses of litigation and preparation therefor) which Indemnified Parties may incur
    1. on account of breach of any of the terms of this declaration furnished hereto, or,
    2. which may be asserted against Indemnified Party by any person, entity or governmental authority;

Further, I affirm that I have read and understood the contents of the foregoing and provide my explicit consent to the same.
